UEGNET FORMAND

Som tidligere medlem af Folketingets Indfødsretsudvalg, er det helt absurd for mig at kunne læse i diverse medier, at Mikkel Bjørn, endog i egenskab af formand for udvalget, vil give afslag til asylansøgere alene på baggrund af deres religiøse overbevisning. Mikkel Bjørn er dog efter de første udmeldinger lidt på retræten. Og det er klogt af Mikkel Bjørn at trække i land.

Det er nemlig direkte i strid med statsborgerretskonventionen at give afslag på baggrund af religion eller tidligere nationalitet. Men er det tilstrækkeligt, at Mikkel Bjørn undskyldende forklarer, at han måske ville overveje at stemme ja, hvis han kendte den enkelte muslimske ansøger? Det er det selvfølgelig ikke.

Man kan jo eksempelvis heller ikke give afslag på fradragsret til alle muslimer. I den forbindelse er det hensigtsmæssigt at skele til Grundlovens § 43 hvorefter ”Ingen skat kan pålægges […] uden ifølge lov”, mens det af Grundlovens § 44 fremgår at ”Ingen udlænding kan få indfødsret uden ved lov”.

Som det ses, er bestemmelserne ”identiske” i forhold til hjemmelskravet, skat kan kun opkræves, og indfødsret kan kun meddeles ved lov. Hvor man ved påligning af skat naturligvis vedtager generelle love, og skaber en ensartet praksis, er der imidlertid ved tildeling af statsborgerskab et retligt kaos.

Af Grundloven fremgår det, at skat pålægges og statsborgerskab gives ved lov. Det betyder, at særligt på disse områder er det af allerstørste vigtighed, at der er generelle regler.

Det gælder selvfølgelig også tilsvarende, at Mikkel Bjørn ikke skal kunne stemme imod statsborgerskabsansøgere blot fordi han ikke kan lide ansøgerne, deres religion, eller oprindelsesland.

Vi skal ikke acceptere, at formanden for Indfødsretsudvalget egenhændigt beslutter at stemme imod statsborgerskab grundet ansøgerens religiøse overbevisning, eller mærkværdige fordomme vedrørende det land hvorfra ansøgeren hidrører
